An overstay in Hanoi gets settled at the city immigration office first, and the exit you pick afterwards, Noi Bai airport or the Huu Nghi land border, only changes the logistics. Under Decree 282/2025, an overstay of under 16 days carries a fine of $19-76 (500,000-2,000,000 VND), and leaving by land neither cancels nor reduces it.

Noi Bai or Huu Nghi: which exit works better after an overstay?

The official advice from immigration police is the office first, for both exits. In practice, visa agencies report that overstays of 1-3 days are often closed at Noi Bai on the day of departure, but that is a custom, not a guarantee, and it is your call. Huu Nghi is a legal exit for e‑visa holders, but no published procedure covers overstayers there, and nothing guarantees an on-the-spot settlement.

Travelers queue at airport passport control
The airport route works to your flight time and often means one queue at passport control after a short overstay.

Here is how the two exits compare for someone with an expired visa:

Noi Bai airportHuu Nghi land gate
Getting thereworks to your flight timeabout 171 km from Hanoi, roughly 3 hours by bus
Opening hoursfollows the flight schedulecloses in the evening, sources say 7 PM to 10 PM, so arrive by midday
Where you end upa third country on your ticketon foot into China
Papers in hande‑visa printout and the fine receipte‑visa printout, phone signal at a remote gate is not reliable
Turn-back risklower with the receipt in handhigher if the record and decision are not finished

Police give the same advice for both exits, and I give it too: go to the immigration office, pay the fine, and do not leave on your own until your status is settled. A fine is issued on paper, as a violation record (biên bản) plus a penalty decision (quyết định xử phạt). Cash handed over without those two documents is not a fine and closes nothing.

What does a Vietnam overstay cost in 2026?

Decree 282/2025/NĐ-CP replaced Decree 144/2021 on 15 December 2025, and Article 21 sets the overstay fines in steps by the number of days. The text and explanations are published by the Vietnam Immigration Department. Dollar figures below use a working rate of about 26,300 VND per $1.

The older decree capped the fine at 20,000,000 VND, and many English guides still print that table. If a page was published before December 2025, its numbers are out of date. A detailed day-by-day breakdown sits in the overstay fine guide.

Where do you go in Hanoi to settle an overstay?

Go to the Hanoi City Police immigration office (Phòng Quản lý xuất nhập cảnh Công an TP Hà Nội) at 44 Pham Ngoc Thach. The police name a second option, the central Immigration Department at 69 Mac Thai To. Turning up on your own counts as a mitigating circumstance, according to the police explanation Tuoi Tre published on 6 August 2026.

Passport handed across an office desk
At the immigration office the officer takes your passport and draws up the record, so bring the passport and the e-visa printout.

Bring your passport and a printout of the e‑visa. The officer draws up the record and the decision, and you pay through a bank or the treasury using the details in the decision, then keep the receipt with both papers. Opening hours differ between sources, so call the day before and set aside a weekday.

This is where trips fall apart: the office works on weekdays, the border gate closes in the evening, and the paperwork takes time, so driving to Huu Nghi without finished documents can end in a turn-back. The office visit itself is simple enough to do alone with a passport and a translation app. At BestBus Vietnam I take over the next step, building the exit from Hanoi and the new e‑visa, as described on the Hanoi visa run page. Send me your travel dates on WhatsApp and I will tell you whether a Hanoi exit and a fresh e‑visa fit this week.

What happens after you walk out through Huu Nghi?

After Huu Nghi you stand in China, not in a third-country airport, and you cannot return to Vietnam the same day without a new visa. Apply for the e‑visa on evisa.gov.vn: the government fee is $25 for a single entry and $50 for multiple entries, valid for up to 90 days. The entry point in the application has to match the gate where you actually cross.

Traveler with a backpack walking toward a border gate
After a land exit you walk out on foot, and the visa overstay record decides how smooth the return will be.

An entry ban, if one follows, comes as a separate decision and its length depends on the seriousness of the violation. There is no single number that fits every overstay. The fewer days you accumulated and the sooner you came to the office yourself, the calmer the situation looks to the officer. Check the status of your visa on the portal before you buy tickets or book a place for your return.

Day-trip logistics for the Chinese side are covered in the guide to Vietnam-China border crossings, and the broader consequences of long stays in fines and entry bans after an overstay.

Which route should you pick?

Start at the Hanoi immigration office: the record, the decision and the receipt in your hands remove the biggest risk, and the rest becomes a routing question. Choose Noi Bai when you want a flight and the overstay is short. Choose Huu Nghi with finished paperwork and a plan for the new e‑visa, and give the trip a whole day.

Buses boarding at a station platform
Buses to the land border leave from a city station, which is why the visa overstay route needs a whole day.

The fine you pay yourself. The part that goes wrong is the chain of exit gate, entry point on the new e‑visa and return date, because one weak link means a second trip to the border. Message me on WhatsApp with your starting city, how many days you are over, and the date you need to be back, and I will work out the route and return date for your case.

Methodology: Where These Numbers Come From

  • Fine scale: Article 21 of Decree 282/2025/NĐ-CP, in force from 15 December 2025. Cross-checked against Tuoi Tre News (25 December 2025), Tuoi Tre (6 August 2026) and the law firm DHTax.
  • Advice to visit the office first and the role of voluntary appearance: explanation from immigration police published by Tuoi Tre, 6-7 August 2026.
  • Hanoi immigration office addresses: legal portal Lawnet and Tuoi Tre.
  • Huu Nghi as a land gate open to e‑visa holders: government Resolution 127/NQ-CP, effective 15 August 2023, with the list amended since.
  • Distance and travel time to Huu Nghi: Vietnam tourism authority and the Mia.vn portal.
  • Deportation procedure: Decree 59/2026/NĐ-CP in force from 1 April 2026, as analysed by LuatVietnam on 30 March 2026.
  • China visa-free regime for Russian citizens: announcement of the Chinese Foreign Ministry, 20 May 2026, reported by Meduza and China Daily.
  • Exchange rate of 26,300 VND per $1 is a working figure for 25 October 2026.

Frequently asked questions

Where do buses to Huu Nghi leave from, and how much is a ticket?

Buses leave from Gia Lam station, and a ticket costs about $6 (150,000 VND) according to the Vietnam tourism authority. The nearest railway station to the gate is Dong Dang, about 3 km away.

Do I need a Chinese visa to walk out through Huu Nghi?

It depends on the passport. Russian citizens can enter China visa-free for 30 days, and the regime was extended to 31 December 2027 in the announcement of 20 May 2026. Holders of other passports should check with the Chinese embassy before travelling.

Can I extend a visa that has already expired?

Extensions are filed before the stay ends. Once it has lapsed, the office records the violation and issues a fine decision, and the officer tells you what is available next, so go there before heading to the border.

Will I get an entry ban, and for how long?

A ban, if one follows, is a separate decision and its length depends on how serious the violation is. Sources do not agree on one number, so ask the office whether a ban was issued before you buy tickets back.

What if I am 16 days or more over?

The fine moves to the 5,000,000-10,000,000 VND step, about $190-380, and every further step is higher. The route does not change: office first, record and decision, receipt, then exit.

What happens if I cannot pay the fine on the spot?

Under Decree 59/2026/NĐ-CP, in force since 1 April 2026, a person who cannot pay may be deported without the fine being collected. The decision must be handed over at least 48 hours before it is carried out, and in that time you can contact your consulate.
